This document outlines the rules and guidelines governing your use of our services, your responsibilities as a client, and our obligations as a service provider. By accessing our website or utilizing any of the services provided by Mercy Home Services, you agree to comply with these Terms & Conditions. If you do not agree with any part of these terms, we kindly ask you to refrain from using our services.

These Terms & Conditions are designed to ensure a clear understanding between you (the client) and Mercy Home Services regarding the scope of our services, payment terms, confidentiality obligations, and other critical aspects of our relationship. We value transparency and want to ensure that all our clients are fully informed about their rights and responsibilities.

Definitions

  1. “Company,” “we,” “our,” or “us” refers to Mercy Home Services, located in Colorado.
  2. “Client,” “you,” or “your” refers to the person receiving services or their authorized representative.
  3. “Services” refers to the Home Care services provided by Mercy Home Services.

Eligibility

  1. You must be at least 18 years of age or have the consent of a legal guardian to use our services.
  2. You represent that you have the legal authority to enter into these Terms & Conditions on behalf of yourself or the person receiving care.

Services

  1. Mercy Home Services provides a variety of Home Care services, including but not limited to personal care, medical care, and companionship. The specific services to be provided will be outlined in a separate service agreement.
  2. Services are provided according to the care plan developed in consultation with the client, family, and care providers.

Service Availability

  1. Services are subject to availability. While we strive to accommodate your scheduling preferences, we cannot guarantee specific time slots or caregivers.
  2. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

Bonuses

Mercy Home Services may, at its sole discretion, offer promotional bonuses to eligible clients transferring services from another agency. Qualification for any such bonus generally requires maintaining active services with Mercy Home Services for a minimum of ninety (90) consecutive days. The bonus amount, if applicable, will be determined based on the total number of service hours completed during the qualifying period. All bonus offers are subject to change or withdrawal without prior notice. Full details, including eligibility criteria and calculation methods, are available upon request.

Payment Terms

  1. Payment terms, including fees, billing schedules, and payment methods, will be outlined in the service agreement.
  2. Invoices are due upon receipt unless otherwise specified in the agreement. Late payments may result in additional fees or suspension of services.

Cancellation and Refund Policy

  1. Cancellations must be made at least [X] hours in advance to avoid a cancellation fee.
  2. Refunds will be provided according to the terms outlined in the service agreement. Mercy Home Services reserves the right to issue refunds at its discretion.

Client Responsibilities

  1. The client is responsible for providing accurate and complete information about their health condition and care needs.
  2. The client agrees to maintain a safe environment for our caregivers.
  3. The client must notify us immediately of any changes in health status or care requirements.

Confidentiality and Privacy

  1. We are committed to protecting your privacy and personal information. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.
  2. All personal health information (PHI) will be handled in accordance with applicable laws and regulations, including HIPAA.

Liability

  1. Mercy Home Services strives to provide high-quality care, but we cannot be held liable for any injury, loss, or damage resulting from the services provided, except as required by law.
  2. The client agrees to release and hold harmless Mercy Home Services, its employees, agents, and affiliates from any claims, liabilities, or damages arising from the use of our services.

Termination of Services

  1. Either party may terminate the service agreement with [X] days’ notice.
  2. Mercy Home Services reserves the right to terminate services immediately if the client violates these Terms & Conditions or if the caregiver’s safety is at risk.

Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising under or in connection with these terms shall be resolved in the courts of Colorado.

Amendments

Mercy Home Services may amend these Terms & Conditions from time to time. Any changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
